This Addendum forms part of Yeli’s Terms and Conditions.
It applies to all Yeli Stokvel – Group memberships and must be read together with our Terms and Conditions, Privacy Policy, and Refund Policy.
By participating in a Yeli Stokvel Group, you acknowledge and agree to this Addendum.
1. Definition of a Group Leader
A Group Leader is a designated representative selected by group members to act as a communication point with Yeli.
- The Group Leader is not an employee, agent, partner, or representative of Yeli
- The Group Leader has no authority to bind Yeli contractually
- The Group Leader acts voluntarily and independently
- Yeli bears no liability for the Group Leader’s actions or omissions
2. Group Structure Rules
- All members within a group must be on the same cycle (11-month or Flex6)
- All members must contribute the same monthly amount
- All group allocations are received together at the same collection event
- Groups operate as a single unit for logistical purposes only, not financially
3. Responsibilities of the Group Leader
The Group Leader is responsible for:
- Coordinating communication between Yeli and group members
- Assisting members to understand payment rules and deadlines
- Coordinating group collection logistics (date, time, location)
- Distributing information from Yeli to group members
- Liaising with Yeli regarding any group-level queries
The Group Leader’s role is limited to coordination and communication. The Group Leader does not assume any financial, legal, or operational responsibilities that belong to Yeli or individual members.
4. Financial Responsibility Disclaimer
Critical Financial Clarification:
- Each member is individually and solely responsible for their own payments to Yeli
- The Group Leader does not collect or handle funds on behalf of Yeli unless expressly agreed in writing with Yeli
- No agency, partnership, or fiduciary relationship is created between Yeli and the Group Leader
- Yeli bears no responsibility for funds collected or managed by a Group Leader outside of Yeli’s direct payment systems
5. Missed Payments by Group Members
Standard payment failure rules apply to each member individually:
- Missed payments before 1 July trigger individual suspension
- Missed payments from 1 July trigger an individual 12-month pause
- One member’s payment failure does not affect other group members
- The 20% administration fee remains non-refundable for all members
6. Leadership Changes
- Groups may change their Group Leader by providing written notice to Yeli
- The new Group Leader must agree to this Addendum
- Yeli is not responsible for internal group disputes, leadership conflicts, or transitions
- Yeli will recognize only one designated Group Leader per group at any time
7. Allocation & Collection
- Group allocations are prepared and distributed together
- Collection details are communicated to the Group Leader for distribution to members
- Failure by any member to collect may result in forfeiture in accordance with the Terms and Conditions and Refund Policy
- The Group Leader is not responsible for individual members’ collection failures
8. Dispute Resolution
Yeli does not arbitrate, mediate, or resolve internal group disputes.
- Disputes between group members are to be resolved internally
- Disputes between members and the Group Leader are internal group matters
- Yeli’s relationship is with each individual member, not with the group as a legal entity
- Yeli will only address issues directly related to Yeli’s service delivery
9. Privacy & Information Sharing
By participating in a group, members acknowledge that:
- The Group Leader will have access to basic member information (names, contact details, payment status) for coordination purposes
- This sharing is necessary for group administration and is permitted under POPIA
- Members consent to this limited information sharing as a condition of group participation
10. Governing Law
This Addendum is governed by the laws of the Republic of South Africa and operates in conjunction with Yeli’s main legal framework.
